Understanding the Process for Clients Over Age 50

If you have a disability that prevents you from working and you are over age 50, you may have an easier time getting approved for Social Security disability (SSD) benefits than a younger applicant. You still need to meet a complex set of criteria, however.

I am Don Anderson, a Clearwater Social Security disability claims attorney with more than 35 years of legal experience. If you need help making an over-age-50 claim for SSD benefits, don't hesitate to contact my office to schedule a free consultation.

Demonstrating That You Are Not Able to Work

When workers in their 30s and 40s develop medical conditions that prevent them from doing heavy labor, they may still have the opportunity to get retrained for jobs that they are medically able to do. Workers over 50, however, often do not have the same opportunities.

The Social Security Administration (SSA) is aware of this, which is why they handle the applications of people over 50 a little differently.

  • Normally, in order to get disability benefits, you need to prove that your medical condition prevents you from doing any job that is generally available in the national economy, as opposed to just the types of work you have done in the past.
  • But if you are over age 50, the SSA will look at your educational and work history before making a decision. If you do not have the background or skills to do the jobs you are medically capable of, you may still get approved for disability benefits.

If you hire me to represent you, I will carefully assemble documentation of your work history, educational background and transferable skills. As a local attorney providing personal service to each client, I handle every case with a high level of attention to detail.

I am dedicated to helping my clients demonstrate that they meet the criteria for over-age-50 claims. Contact me today to discuss your case with an experienced SSD lawyer.
