Helping Clients Understand the Initial Determination Process
When you file a claim for Social Security disability benefits, the Social Security Administration will make an initial determination on your claim based on the available information. If your claim is denied at this stage, you may still have a very good chance of getting benefits.
I am Don Anderson, a Clearwater Social Security disability attorney with more than 35 years of legal experience. I am dedicated to helping my clients understand the initial determination process. To discuss your case, contact my office today to schedule a free consultation.
Don't Give Up if Your Initial Disability Claim Is Denied
A relatively small minority of the people who apply for Social Security disability benefits get approved for those benefits at the initial determination stage. Largely, these are people who are confined to hospital beds or otherwise clearly disabled from doing any type of work.
If the Social Security Administration needs more evidence that you are actually disabled, you will need to appeal your claim and present that evidence at a disability hearing.
A majority of applicants who appeal their claims are successful at the hearing stage. While you cannot predict the outcome of your unique case based on other people's past results, this is a very strong indication that the initial determination process is far from perfect.
If you are filing a claim for disability benefits, you should be prepared for the possibility that the initial determination will go against you. If your claim has already been denied, you should not lose hope. Contact me today to discuss how I can help you pursue the benefits you deserve.
